What is a parking space rental agreement?
Renting out a spare parking space, driveway or garage is simple income, but without a written agreement it's easy to disagree about who can park there, what can be stored, who pays if something is damaged, and how either side ends it. A parking space rental agreement (or parking licence) puts those terms in writing.
This template identifies the space and its type — uncovered, covered, in a shared garage, a private lock-up or a driveway — its access hours and any keys, fobs or remotes. It names the one vehicle allowed and requires it to be roadworthy, registered and insured. It sets a fixed or rolling term, the fee and when it's due, an optional deposit, and how the fee can change. The renter agrees not to block others, do repairs, leave leaks or store fuel, with optional storage and EV charging terms. It covers risk and liability for the vehicle and damage, the owner's access for repairs with a fee reduction if the space is unavailable for a while, no subletting, and notice to end, removing the vehicle and what happens to anything left behind.

Using the parking space rental agreement, step by step
1 Describe the space and access
Enter the address, which space it is (level and number), the type of space and the access hours. List any gate remote, key or fob you hand over — the renter must return them at the end.
2 Name the vehicle
Add the make, model, colour and registration. The renter can switch to a similar-sized replacement after telling you in writing, but can't let anyone else use the space.
3 Set the term, fee and deposit
Choose a start date and either an end date or leave it empty for a rolling agreement. Enter the fee, how often it's paid and when it's due, the notice period, and an optional deposit.
4 Decide on storage and charging, then sign
Say what, if anything, can be stored, and whether EV charging is allowed and how it's billed. Add the governing law and send it to the renter to sign and initial.
Tips Before You Send It
- If you rent the space from a landlord or it belongs to a building, check you're allowed to sublet it before you advertise.
- Tell your insurer — renting out a space or garage can affect home or building insurance.
- Take a photo of the space at the start so any damage is easy to show later.
- Abandoned vehicles can only be removed as local law allows. Keep the renter's contact details up to date.

Parking space rental agreement: frequently asked questions
Is renting a parking space a lease?
This agreement says it gives the renter permission to park, not a lease of land or a building. How the law treats it can vary by place, so check if that matters to you.
Who is responsible if the car is damaged or stolen?
The renter parks at their own risk. The owner is responsible only to the extent the owner or their staff or contractors were negligent or acted deliberately, or where the law doesn't allow that to be excluded.
Can I raise the fee?
Yes, with written notice of at least the notice period you set, but not during a fixed term. The renter can end the agreement instead of accepting the change.
Is an e-signed parking agreement valid?
Electronic signatures are generally valid for ordinary contracts like this in the US (ESIGN Act and UETA), the UK, the EU (eIDAS) and Canada. VergeHR keeps an audit trail with the signed PDF.
