What is a advertising space rental agreement?

An advertising space rental agreement is used when the owner of a visible surface — a roadside billboard, a gable wall, a shop window, a fence along a sports ground, an indoor display, or the sides of a van — lets a business put its advertising there for a set period and fee. It records exactly where the ad goes, for how long, who produces and installs it, and what happens if it's damaged or can't be seen.

The template covers the space, size and optional lighting, extra duties when the space is a vehicle, the campaign dates and first chance to extend, optional competitor exclusivity, the space fee and any production and installation fee, artwork deadlines, specifications and approval, the advertiser's responsibility for lawful content, upkeep with a pro-rata credit if the ad isn't displayed, removal, liability and ending early.

Advertising space rental agreement: frequently asked questions

Can the owner refuse an advert?

Yes, for good reason. The owner may refuse artwork that is unlawful, misleading, obscene or offensive, that breaches a permit, signage rule or the owner's lease, or that could reasonably damage its reputation, but may not refuse or delay approval unreasonably.

What if the ad is damaged or covered up?

The owner fixes the problem within a reasonable time. If, through no fault of the advertiser, the ad isn't properly displayed for more than 3 days in a row, the advertiser gets a proportional credit on the space fee for the whole time it was down. Any replacement artwork comes from the advertiser.

Who is responsible for what the ad says?

The advertiser. It confirms the content complies with advertising and consumer law and that it has the rights to the images, trade marks and people shown, and covers the owner against claims about the content.

Is an advertising agreement signed online valid?

In most countries, including the US (ESIGN Act and UETA), the UK, the EU (eIDAS) and Canada, an electronic signature is generally valid for an ordinary commercial contract like this one. VergeHR keeps an audit trail and a Certificate of Completion with the signed PDF.

Is this template free?

Yes. The template is free to use with the eSignature app in VergeHR, and the advertiser doesn't need a VergeHR login to sign.
