What is a employee referral bonus agreement?
Referral bonuses are one of the cheapest ways to hire good people, but they cause friction when the terms are vague: two employees claim the same candidate, the new hire leaves after six weeks, or the referrer resigns before payday. An employee referral bonus agreement settles those questions for one specific referral before anyone is out of pocket.
This template names the employee, the candidate and the position, and sets the bonus amount, the qualifying period the new hire must stay, and whether it is paid in one go or in two halves. It lists the usual exclusions — candidates already in your pipeline, agency introductions, hiring managers referring into their own team — and gives the bonus to whoever referred first. You also choose whether the bonus survives the referrer leaving, and it confirms the candidate will be assessed like any other applicant.

Using the employee referral bonus agreement, step by step
1 Identify the referral
Enter the referring employee, the candidate, the position and the date you received the referral — that date decides who referred first. If the candidate has already been hired, add their start date; if not, set how long the referral stays valid.
2 Set the bonus and qualifying period
Enter the gross amount and how many months the new hire must stay before the bonus is earned. Choose one payment after that period, or half after the start date and half after the period.
3 Decide what happens if the referrer leaves
Choose whether the referrer must still be employed on the payment date. Rules on bonuses already earned differ between places, so check before relying on the stricter option. Name your referral policy if you have one.
4 Send it for signature
Add the referring employee's email and sign for the company. Both of you initial each page, and the signed agreement is filed in Files — useful evidence when payroll asks why the bonus was paid.
Tips Before You Send It
- Put the qualifying period somewhere between the end of probation and the point where most bad hires leave — three to six months is common.
- Record the referral date as soon as it arrives. It is what resolves "who referred first" disputes.
- Tell payroll the bonus is taxable pay so deductions are made correctly.
- Keep the referrer out of the hiring decision for their referral, as the agreement requires, to keep the process fair.
Sign It Online In Minutes

- Send it. Each signer gets a secure link and signs from any device — no account needed. The signed PDF, with an audit trail and a Certificate of Completion, is filed in Files and emailed to everyone.
Employee referral bonus agreement: frequently asked questions
Is a referral bonus taxable?
Generally, yes — it is treated as pay. The agreement says the company will make the tax and other deductions the law requires, and that the stated amount is gross.
What if the new hire leaves early?
If they leave, or give or receive notice, before the qualifying period ends, no bonus is due. With the two-part option, the first half already paid is not reclaimed, but the second half is not paid.
What if two employees refer the same person?
The bonus goes only to whoever's referral the company received first, and it is paid once per candidate, even if they are later rehired.
Can an employee sign this electronically?
Yes. In most countries, including the US (ESIGN Act and UETA), the UK, the EU (eIDAS) and Canada, an electronic signature is generally valid for an ordinary employment document like this. VergeHR keeps an audit trail and a Certificate of Completion with the signed PDF as evidence of who signed and when.
Is this template free?
Yes. The template is free to use with the eSignature app in VergeHR. Signers don't need a VergeHR login.
