What is a personal driver agreement?

When a household hires a private driver — for the school run, a parent's appointments, or a busy executive's day — the arrangement is usually a job like any other, with hours, pay and rules. A written agreement protects both sides: the driver knows the schedule, what counts as working time and how overtime is paid, and the family knows the driver is licensed, insured, sober and discreet.

This template covers whether the driver works as an employee or a self-employed contractor, an optional trial period, duties and who the driver will drive, the normal schedule and weekly hours, waiting time and rest breaks, pay and overtime, taxes, time off, whether the driver uses the family's car or their own (with insurance, running costs and a mileage allowance), licence and fitness to drive, safety rules including child seats, fines, confidentiality and privacy, conduct, notice and immediate termination for serious misconduct, and governing law. VergeHR places both signatures, dates and initials.

Using the personal driver agreement, step by step

1 Choose employee or contractor

Pick how the driver is engaged. The template's tax wording follows your choice. Whether someone is legally an employee depends on local law and how the work is done, so check the rules for household employers where you live.

2 Set the schedule and duties

Describe the normal days and hours and the weekly total. The duties are pre-filled — driving, waiting and collecting, keeping the car clean and checked, and errands — edit them to fit.

3 Agree the vehicle and pay

Choose the family's car or the driver's own, add the make and plate, and a mileage allowance if it's the driver's car. Enter the pay rate and frequency, the overtime rate, and any extras for late nights or trips away.

4 Time off, notice and send

Describe paid time off and holidays, set the notice period, and add an optional trial period. Add the driver as signer and send; the signed copy lands in VergeHR Files.

Tips Before You Send It

  • Check your local rules for household employers: minimum wage, overtime, paid leave, tax registration and any required insurance. The template says the driver always gets at least what the law requires.
  • Tell your car insurer that someone else will drive your car regularly — in the template, you promise that your insurance covers the driver.
  • If the driver uses their own car, ask to see insurance that covers carrying your family for work, not just personal use.
  • Keep a copy of the driver's licence and, with their consent and where the law allows, check their driving record.

Personal driver agreement: frequently asked questions

Is my driver an employee or a contractor?

It depends on local law and how the work is really done, not only on what the contract says. A driver who works set hours, in your car, under your direction is often treated as an employee. The template lets you choose, and the tax and pay wording changes to match, but check your local rules.

Does waiting time count as working time?

Yes, under this template. Time the driver spends waiting on duty — staying with the car or ready to drive — counts as working time, and hours beyond the normal weekly hours are paid at the overtime rate you set, and at least any rate the law requires.

Who pays parking and speeding fines?

Fines for offences caused by the driver's own driving are the driver's responsibility. Parking charges incurred on the family's instructions are paid by the family, as are tolls and parking costs while working.

Is a driver contract signed online valid?

In most countries, including the US (ESIGN Act and UETA), the UK, the EU (eIDAS) and Canada, an electronic signature is generally valid for an ordinary employment or services contract like this one. VergeHR keeps an audit trail and a Certificate of Completion with the signed PDF.

Can I change the wording?

You fill in the blanks and choose the options; optional clauses appear only when you fill them in. For different clauses, upload your own document to VergeHR eSignature and place the signature boxes in the editor.

Is this template free?

Yes. The template is free to use with the eSignature app in VergeHR. The driver doesn't need a VergeHR login to sign.
