What is a mystery shopper agreement?
Mystery shopping gives a business an honest view of the customer experience: whether staff greet customers, follow the sales process, keep the store clean or handle a complaint well. Whether you run the programme yourself or through an agency, the shoppers are usually freelancers who pick up assignments as they suit them. A signed agreement sets the ground rules once, so each assignment offer only has to cover the details of that visit.
This template makes each assignment optional to accept, with the offer setting the location, visit window, instructions and pay. Shoppers agree to stay discreet, avoid conflicts of interest, stay safe and follow the law, with a clear choice about audio and video recording. Reports must be honest and on time; the template explains when a report is accepted and when a fee can be declined — after the shopper has had a chance to explain. It covers the standard fee, purchase and travel reimbursements, a plain warning about common mystery-shopping scams, independent-contractor status, confidentiality of clients and findings, staff personal data, and ending the arrangement.

Using the mystery shopper agreement, step by step
1 Describe the assignments
Say what kinds of assignments you offer — in-store visits, phone calls, online orders — and the usual area. Each offer then adds the specific location, visit window and instructions.
2 Set reporting and recording rules
Choose how many hours the shopper has to file the report and how reports are submitted. Decide whether audio or video recording is ever allowed; the safe default is no, because recording people without consent is restricted in many places.
3 Set fees and reimbursements
Enter the standard fee per accepted report, the usual purchase reimbursement limit, any travel or mileage rate, and how often you pay. An individual offer can set a different fee for a harder assignment.
4 Send it to the shopper
Choose the notice period for ending the arrangement and the governing law, then send it to the shopper to sign before their first assignment.
Tips Before You Send It
- Keep your questionnaire factual — times, names on badges, yes/no checks — so reports are easier to verify.
- Rotate shoppers so the same person doesn't visit the same location too often.
- Pay reimbursements promptly; shoppers are out of pocket until you do.
- If you tell shoppers exactly how, when and where to work and they work only for you, take advice on whether they are really contractors.

Mystery shopper agreement: frequently asked questions
Is a mystery shopper an employee?
This agreement treats the shopper as an independent contractor: they choose which assignments to accept, use their own transport and pay their own taxes. Whether that status holds depends on how the relationship works in practice and on local law.
Can we refuse to pay for a poor report?
The company can decline the fee for a report that isn't submitted, is late without a good reason or doesn't follow the instructions — but only after giving the shopper a chance to explain. A report the company shows to be invented isn't paid and ends the agreement.
Why does the agreement mention scams?
Fake mystery-shopping offers are a common fraud: victims are asked to deposit a cheque, then send money on or buy gift cards. The agreement states that the company will never ask for this, so shoppers can spot a fake message using its name.
Is an electronically signed shopper agreement valid?
Electronic signatures are generally valid for ordinary contracts like this in the US (ESIGN Act and UETA), the UK, the EU (eIDAS) and Canada. VergeHR keeps an audit trail and a Certificate of Completion with the signed PDF.
