What is a photography services agreement?
A photography services agreement is the contract a photographer and client sign before a shoot. It turns a quote and a few emails into clear commitments: what will be photographed, when and where, how many edited images the client gets and by when, what it costs, what happens if the shoot has to move, and — most importantly for the photographer — what the client may do with the images.
This template works for portrait, headshot, family, product, commercial, brand, real estate, food and event shoots. The photographer keeps the copyright and licenses the delivered images for the use you choose: personal use, the client's own marketing, or any commercial purpose including advertising. It covers the brief, a minimum number of edited images and the editing included, delivery time and method, a deposit and balance, optional extra images, overtime and travel, free rescheduling with notice, weather, what happens if the photographer can't attend, portfolio use, permissions and model releases, and a limit on liability for lost images.

Using the photography services agreement, step by step
1 Describe the shoot
Choose the type of shoot and write the brief — what will be photographed and the look agreed. Enter the date, start and finish time, and location.
2 Set the deliverables
Enter the minimum number of edited images, the editing included, how many days after the shoot they are delivered and how — online gallery, download link or gallery plus USB.
3 Choose the image licence
Pick what the client may use the images for. Personal use suits family portraits; the client's own marketing suits most business shoots; full commercial use covers advertising and packaging and is usually priced higher.
4 Set the fee and send
Enter the total fee, the deposit and when the balance is due, plus optional prices for extra images, overtime and travel. Set the rescheduling notice, then add the client and send.
Tips Before You Send It
- Ask for the deposit on signing — it reserves the date and counts towards the fee.
- For advertising or packaging use, get a model release from everyone identifiable in the images. The agreement says you can supply the form; the client is responsible for any permissions its use needs.
- Back up images on the day of the shoot. The agreement limits your liability for lost images to a reshoot or refund, but a backup avoids the conversation entirely.
- Tell clients how long you keep galleries — the agreement says at least 12 months — so they download and back up their images.
Sign It Online In Minutes
- Fill in the blanks. Names, dates and amounts go straight into the agreement — the preview shows exactly where.
- Name who signs. Tick “This is me” for your own part. VergeHR builds the PDF with every signature, date and initials box on the right line, and you can check or move anything before sending.
- Send it. Each signer gets a secure link and signs from any device — no account needed. The signed PDF, with an audit trail and a Certificate of Completion, is filed in Files and emailed to everyone.
Photography services agreement: frequently asked questions
Who owns the copyright in the photos?
The photographer. Once the fee is paid in full, the client receives a permanent licence to use the delivered images for the purpose chosen in the agreement. Selling or licensing them to others, or passing them off as the client's own work, needs the photographer's consent.
Does the client get the raw files?
No. The agreement says unedited or raw files are not provided; the client receives the edited images. Additional retouching is quoted separately.
What happens if the client cancels?
The client can move the shoot once, free, with the notice you set. If it cancels or reschedules at shorter notice, the deposit is kept. If weather makes an outdoor shoot impractical, either side can move it at no charge.
Can a photography contract be signed electronically?
In most countries, including the US (ESIGN Act and UETA), the UK, the EU (eIDAS) and Canada, an electronic signature is generally valid for an ordinary commercial contract like this one. VergeHR keeps an audit trail and a Certificate of Completion with the signed PDF as evidence of who signed and when.
Is this template free?
Yes. The template is free to use with the eSignature app in VergeHR. Signers don't need a VergeHR login.
