What is a shared driveway agreement?

Shared driveways are a common source of neighbour disputes: blocked access, parked cars, potholes nobody wants to pay for, and snow that one side always clears. A short written agreement sets expectations on both sides.

This template describes the driveway and who owns the land under it, gives both households and their visitors access at all times, sets parking rules, bans obstructions without consent, and covers maintenance, urgent repairs, snow, cost sharing with a spending limit, damage caused by one side, mediation, and what happens when either home is sold or let. It notes that recording it as an easement may need extra formalities.

Tips Before You Send It

  • Attach a plan — a marked-up satellite image is better than words alone.
  • Check your deeds first; an existing legal right of way takes priority over this agreement.
  • If you want it to bind future owners, ask a lawyer about recording it as an easement or covenant.
  • Keep invoices for shared work in Files so the split is easy to show.

Shared driveway agreement: frequently asked questions

Will this bind someone who buys my neighbour's house?

Not automatically. It's a personal agreement unless recorded or registered as an easement or covenant in the form the law requires. Each owner agrees to tell a buyer about it and ask them to sign a confirmation.

What if my neighbour won't pay their share?

The agreement requires payment within 30 days of receiving the invoice, and sets out good-faith talks followed by mediation before court.

Can either of us put up a gate?

Not without the other owner's written consent. Neither may obstruct the driveway or change its surface or route alone.

Is an e-signed neighbour agreement valid?

Electronic signatures are generally accepted for ordinary agreements like a neighbour agreement in the US (ESIGN Act and UETA), the UK, the EU (eIDAS) and Canada, though local rules can add requirements. VergeHR keeps an audit trail and a Certificate of Completion with the signed PDF.
