What is a neighbour fence agreement?
A good fence agreement keeps good neighbours. Before anyone digs a post hole, it helps to agree in writing exactly where the fence goes, how high it is and what it's made of, which side the finished face points to, what it costs and who pays what — and who fixes it when a storm knocks a panel out in five years' time.
This template covers the location and position of the fence (centred on the boundary or wholly on one side), a clear statement that it doesn't move or settle the legal boundary, design and materials, removing an old fence, permits and utility checks, the contractor and agreed cost, an equal or custom cost split, how extra costs are approved, timing, access to each other's land, ownership and future upkeep, what happens if a property is sold, and resolving disagreements by talking and mediation first.

Using the neighbour fence agreement, step by step
1 Pin down where it goes
Describe the fence line in words a stranger could follow — from which post to which corner, and roughly how long. Choose whether it sits centred on the boundary or entirely on one neighbour's land. If you're unsure where the boundary is, agree whether to get a survey first.
2 Agree the design
Describe the height, material and style, and which property the finished side faces. For a replacement, the agreement includes removing the old fence.
3 Split the cost
Name the contractor and enter the quoted total. Choose an equal split or describe your own, how each neighbour pays, and how much extra either may approve alone if something unexpected comes up. Add start and finish dates if you have them.
4 Agree the future and sign
Choose how upkeep is shared, add the governing law, and send it to your neighbour. Both of you sign online, with initials on each page, and the signed copy is filed in Files.
Tips Before You Send It
- Check permit, planning and homeowners' association rules on fence height and position before you order materials.
- Call your local utility-locating service before digging post holes.
- Take photos of the boundary and the old fence before work starts, and keep the contractor's quote with the signed agreement.
- Some places have fence or boundary laws that set how neighbours share costs. Where they cover something your agreement doesn't, they apply.

Neighbour fence agreement: frequently asked questions
Does signing this settle where the property line is?
No. The agreement says the neighbours believe the fence follows the boundary, but it does not move, fix or settle the legal boundary, and neither neighbour gives up any boundary rights by signing.
Who owns the fence afterwards?
The neighbours own it together, unless it is built entirely on one neighbour's land, in which case it belongs to that neighbour. Upkeep follows the option you choose.
What if one of us sells?
The seller tells the buyer about the agreement. Whether it binds a later owner depends on local law, but the neighbours record that they intend the upkeep duties to pass on where possible.
Is an electronic signature enough?
In the US (ESIGN Act and UETA), the UK, the EU (eIDAS) and Canada, electronic signatures are generally valid for ordinary contracts like this one. VergeHR keeps an audit trail and a Certificate of Completion with the signed PDF as evidence of who signed and when.
Is this template free?
Yes. The template is free to use with the eSignature app in VergeHR. The other party doesn't need a VergeHR login to sign.
