What is a tutor contractor agreement?

Tutoring companies and agencies usually work with freelance tutors: the company finds the families, sets and collects the fees and runs the platform, and the tutor teaches. Because tutors work with children, often one to one, the agreement has to do more than set a rate — it needs clear safeguarding rules and a firm approach to student information. And because families sometimes offer to pay a tutor directly, it needs a fair rule about that too.

This template sets out the subjects and levels, whether sessions are online, in person or both, and how students are offered and accepted. It sets the tutor's rate per hour or per session, what the tutor is paid for late cancellations and no-shows, and the pay schedule — with the company paying the tutor whether or not the family has paid. The safeguarding section requires the background check you name and sets practical rules for in-person and online sessions, contact with students, and reporting concerns to a named safeguarding lead. It also covers confidentiality of student information, ownership of teaching materials, no completing graded work for students, a time-limited promise not to tutor the company's families privately (with an optional transfer fee), independent-contractor status and ending the agreement.

Using the tutor contractor agreement, step by step

1 Describe the tutoring

Enter the company and tutor details, the start date, the subjects and levels, and whether sessions are online, in person or either.

2 Set rates and cancellations

Enter what you pay the tutor per hour or per session, how many hours' notice counts as a late cancellation, and what the tutor is paid for a late cancellation or no-show: the full rate, half, or nothing. Choose the pay schedule.

3 Set the safeguarding requirements

Name the background check the tutor must complete — the right check depends on where you operate — and your safeguarding lead's name and contact details, which are printed in the agreement.

4 Protect your families and send

Choose how many months the tutor may not tutor your families privately after the agreement ends, and optionally a one-off fee that lets a family move to the tutor with your consent. Set the notice period and governing law, then send to the tutor.

Tips Before You Send It

  • Complete background checks and check references before you offer a tutor any students.
  • Give tutors your full safeguarding policy with the agreement and ask them to confirm they have read it.
  • Keep the family non-solicitation period reasonable; many tutors see a transfer fee as fairer than an outright ban, and it gives families a clear way to continue with a tutor they like.
  • Run sessions for children on your own platform so you can manage recordings, links and messages in line with your policy.

Sign It Online In Minutes

Tutor contractor agreement: frequently asked questions

Can a tutor take on a family privately after leaving?

Not for the months you set, if the company introduced that family — unless the company agrees in writing. If you add a transfer fee, the company won't unreasonably refuse consent once the tutor pays it. Restrictions like this are limited or unenforceable in some places, so keep them reasonable.

Is the tutor paid if a student doesn't turn up?

You choose: for a cancellation inside your notice window or a no-show, the tutor gets the full rate, half the rate, or nothing. Sessions cancelled with more notice are not paid.

What background check does a tutor need?

It depends on the country and the kind of work — for example, a criminal record check suitable for work with children. The agreement leaves the check as a blank for you to name.

Can a tutor e-sign this agreement?

Yes. The tutor receives a secure link and can sign and initial on any device without a VergeHR account. Electronic signatures are generally valid for ordinary contracts like this in the US (ESIGN Act and UETA), the UK, the EU (eIDAS) and Canada.
